Terms of Service

Welcome to Igipe. These Terms of Service (the â€œTermsâ€) govern your access to and use of the Igipe platform, including igipe.com and related services (the â€œIgipe Platformâ€). By using the Igipe Platform, you acknowledge and agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Acceptance of Terms

By accessing or using the Igipe Platform, you affirm that you have read, understood, and accepted these Terms and our Privacy Policy. You agree to comply with all applicable laws and regulations when using the Platform. Igipe may revise these Terms from time to time; continued use after changes constitutes acceptance of the revised Terms. We will publish the updated Terms on igipe.com and, where required, notify registered users.

2. Intellectual Property

All intellectual property embodied in the Igipe Platform, including but not limited to logos, branding, interface designs, source code, algorithms, and content created by Igipe (the â€œIgipe IPâ€), is owned by Igipe or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Igipe Platform for legitimate purposes in accordance with these Terms. You may not reproduce, modify, distribute, republish, or create derivative works of the Igipe IP without prior written consent from Igipe, except as expressly permitted by law or as part of permitted use of the Platform with attribution where applicable.

3. Third-Party Links and Content

Igipe aggregates and curates listings and content for discovery purposes. The Platform may display links to third-party websites, applications, or content that are not owned or controlled by Igipe. Igipe has no control over such third-party materials and assumes no responsibility for their availability, accuracy, or safety. The inclusion of third-party links does not imply endorsement or sponsorship by Igipe.

4. Apps Hosted on Google Play

Igipe serves as a discovery and referral platform. The apps listed on Igipe are hosted on Google Play and not hosted on igipe.com or within the Igipe Platform itself. Your download and use of any listed application are governed by Google's Terms of Service and Google Play policies. Igipe does not own, operate, or guarantee the availability, security, or performance of these third-party apps. Any interactions with such apps occur at your own risk.

5. Disclaimer of Warranties

THE IGIPE PLATFORM IS PROVIDED â€œAS ISâ€ AND â€œAS AVAILABLE.â€ TO THE FULLEST EXTENT PERMITTED BY LAW, IGIPE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IGIPE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH YOUR EQUIPMENT OR SOFTWARE. APP DATA ACCURACY AND AVAILABILITY ARE NOT GUARANTEED.

6. Limitation of Liability

IN NO EVENT SHALL IGIPE OR ITS DIRECTORS, OFFICERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE IGIPE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE TOTAL CUMULATIVE LIABILITY OF IGIPE FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE FEES PAID, IF ANY, BY YOU TO IGIPE FOR THE USE OF THE PLATFORM IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS (USD 100), WHICHEVER IS GREATER, TO THE EXTENT PERMITTED BY LAW.

7. Indemnification

You agree to indemnify, defend, and hold Igipe and its affiliates harmless from and against any claims, losses, damages, or expenses, including reasonable attorneyâ€™s fees, arising out of your use of the Igipe Platform in violation of these Terms or any applicable law, or your violation of any rights of a third party.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Igipe is primarily headquartered, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms shall be resolved in the state or federal courts with exclusive jurisdiction in that jurisdiction.

9. Termination

Igipe may suspend or terminate your access to the Platform at its sole discretion for conduct that violates these Terms or for any reason that Igipe deems appropriate, with or without notice. Upon termination, your right to use the Platform ceases, and you must discontinue all use immediately. Provisions that by their nature should survive termination shall remain in effect.

10. Changes to Terms

Igipe reserves the right to modify these Terms at any time. We will provide notice of material changes as required by law. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
